Bid participation qualification

Agent/delegator of bidder qualification

Updated: July 2025, 8

"Accepting an assignment" refers to the act of the applicant (head office etc.) delegating, as part of an application for registration and review of bidder qualifications, the authority to conclude contracts etc. to a branch office (branch manager) or sales office (director) etc., and the agent assumes the obligation to carry out "legal acts such as bidding, quotations, concluding contracts, or requesting and receiving payment" with each organization in his/her own name and responsibility.

What is a trustee?

An agent refers to a branch office (branch manager) or sales office (director) etc. that has been delegated the authority to conclude contracts etc. by the head office etc. that is the applicant for the bidder qualification registration review application.

The “delegated person” who has been delegated by the head office/representative shall, in his or her own name and responsibility, communicate with each organization."Legal acts such as bidding, quotation, conclusion of contract, requesting and receiving payment, etc."must be done.

Requirements and notes for the person in charge

Requirements for the person in charge, etc.
1Depending on the prefecture where the head office is located, it may not be possible to appoint a contractor for construction work or consulting. (In the case of consignment/goods, there are almost no restrictions)
2In most cases, municipalities outside the prefecture are able to appoint a trustee for construction, consulting, general outsourcing, and goods, regardless of whether the head office is located within the prefecture.
3The business office of the person in charge must have obtained a construction business license applicable to the type of industry for which the application is being made.
4Even if the company has a construction business license and has undergone financial audit, if the branch office of the person in charge does not have a construction business license, the company can only certify only "minor construction work."
5This is different from delegation, where a sales representative goes to a bidding venue on behalf of a representative or delegate and submits a power of attorney for each bid item.
6A representative cannot be registered as a trustee.
7The recipient cannot be the applicant.
8Must be a regular employee (including executives).
9The person in charge must not be a person who does not have the ability to conclude a contract related to competitive bidding, etc., or a bankrupt person whose rights will not be reinstated.
10The place of assignment refers to the office, etc. to which the assigned person belongs and receives work for the prefecture or each organization.

In competitive bidding processes, when company representatives are unable to participate in person, they may delegate authority over bidding and contracts to certain employees or agents.

Relationship between the agent and the principal

A delegator is a person who represents a company or has the authority to enter into a contract, while a representative is a person who has been formally delegated that authority.
In many cases, the branch manager or sales office manager serves as the agent, and they carry out bidding and contract procedures in their own name and responsibility.

About power of attorney

A power of attorney is used to acknowledge that the agent has the authority to carry out all procedures related to the application for bid qualification on behalf of the principal.
A power of attorney usually contains the names, addresses, titles, details of the delegation, and date of the principal and agent.
