Legal basis and type of permission (manufacturing industry)

 

To manufacture and sell cosmetics in Japan, a "manufacturing license" and a "manufacturing and sales license" are required under the Pharmaceuticals and Medical Devices Act (formerly the Pharmaceutical Affairs Act). A manufacturing license is required for the factory where the actual manufacturing takes place, while a manufacturing and sales license must be obtained by the "seller" who distributes the product under their own brand.

Human requirements (responsible engineer qualifications, etc.)

A manufacturing license requires the appointment of a "chief engineer." As a requirement, one of the following qualifications and experience is required.

  • pharmacist
  • Those who have earned credits in chemistry, pharmacy, etc. at a university, etc. *In the case of Tokyo, 12 credits or more
  • High school graduate or above with 3 years or more experience in safety management/quality control at a company licensed to manufacture and sell cosmetics (practice certificate required)

General procedure for obtaining a cosmetics manufacturing license

Consultation and application First, please contact us by phone or through the inquiry form. After confirming your current situation, we will explain the application policy. Please consult with the person in charge regarding the timing of payment of the fee and the success fee. Preliminary consultation, on-site inspection if necessary We will advise you on the construction of the structure and equipment and internal system required for the application. Depending on the jurisdiction, we will conduct a preliminary consultation with the pharmaceutical affairs department or health center. Basically, we can act on your behalf alone, but we may ask you to accompany us. Issuance of license In the case of Tokyo, after receiving the permission postcard, you will go to pick up the license. Depending on the jurisdiction, you may be contacted by phone instead of the permission postcard (such as Kyoto Prefecture). Application agency After preparing the application documents at our company, we will submit the entire application to the pharmaceutical affairs department of the prefecture in charge (※ In rural areas, it may be via the health center). At that time, a fee will be paid. The amount of the fee also varies depending on the prefecture to which the application is made. On-site inspection After submitting your application, you will be contacted by the Pharmaceutical Affairs Division within 1-2 weeks to arrange a schedule for the on-site inspection. For the on-site inspection, usually about two officers will visit your company. They will check the application details, confirm the knowledge and experience of the person in charge, confirm the status and content of the procedure manual, and confirm the location. Starting business Cosmetics manufacturers and distributors who actually sell cosmetics are required to complete the product procedures in advance. Advance procedures are also required when selling imported cosmetics.

  • If using other testing and inspection organizations, a copy of the usage summary and contract of the other testing and inspection organization or a certificate of usage

Confirmation of reasons for disqualification

If any of the following apply, you will not be able to obtain permission (Article 12 of the Pharmaceuticals and Medical Devices Act).

  • Those who have been sentenced to imprisonment or more and have not yet completed the sentence for five years.
  • Those who have had their license revoked due to a violation of the Pharmaceuticals and Medical Devices Act within the past five years
  • Organized crime

If applying as a corporation, confirmation from all officers is required.

Permit changes and renewal procedures

If any of the following changes occur, you must promptly notify us or apply for changes.

  • Company registration information, such as trade name, address, and responsible officer
  • Name and address of responsible engineer
