Requirements for obtaining a permit
The requirements for obtaining a general passenger transport business license limited to welfare transport are as follows.
Business area
①Prefectural unit.
However, in the case of establishing a business office in a municipality that borders a prefecture, there is no separation due to topographical factors such as mountains, rivers, straits, etc., and there is no separation due to topographical factors such as mountains, rivers, straits, etc., and it is located in a neighboring prefecture that is recognized as the same area in view of economic circumstances etc. If the Director of the Transport Bureau deems it appropriate for a municipality, an area including neighboring municipalities may be designated as a business area.
In addition, if the area of the municipality is changed due to merger etc. after establishing an area that includes neighboring municipalities, the previous area will be the business area.
② Establish a business office in a business area (excluding areas of adjacent municipalities as provided in the proviso to (1)).
Human requirements
There must be a driver, operation manager/instructor, and maintenance manager.
①Driver
・Must have a Class 2 Ordinary License.
② Regarding the establishment of operation managers and instructors
・If you own up to 4 vehicles, no qualification is required.
・If the number of vehicles in your fleet exceeds 5, you will need to appoint a qualified operation manager.
・It is possible to serve as both an operation manager and an instructor.
③ Regarding the establishment of a maintenance manager
・If you own up to 4 vehicles, no qualification is required.
- If the number of vehicles in your fleet exceeds 5, you will need to deploy qualified personnel such as mechanics.
・It is possible to serve as both a maintenance manager and a driver.
Equipment requirements
Business offices, garages, rest facilities, and vehicles must meet the following requirements.
①Sales office
・It must be located within the business area for which you are applying. If the business has multiple business areas, it must be located within each business area.
・The applicant must have the right to use the land and building for three years or more.
・Do not conflict with related laws and regulations such as the Building Standards Act, City Planning Act, Fire Service Act, and Agricultural Land Act.
- The scale is sufficient to accurately carry out the business plan.
②Garage
・As a general rule, it must be attached to the business office. However, if this is not possible, the facility must be located within a business area within 2 kilometers in a straight line from the business office, and must be fully capable of operation management and other operations.
- The boundaries between vehicles and garages and the distance between vehicles must be at least 50 centimeters, and all business vehicles located at the business office can be accommodated.
・It must be clearly separated from areas used for other purposes.
・The applicant must have the right to use the land and building for three years or more.
・Do not conflict with related laws and regulations such as the Building Standards Act, City Planning Act, Fire Service Act, and Agricultural Land Act.
・Facilities for inspection, maintenance, and cleaning of commercial vehicles must be provided.
・The structure must not impede the entry and exit of business vehicles, and the front road must not violate vehicle restriction ordinances. In addition, if the front road is a private road, the approval of the person who has the right to use the private road must be obtained, and the public road connected to the private road must not conflict with the Vehicle Restriction Ordinance.
③ Facilities for rest, nap or sleep
・As a general rule, it must be attached to a business office or automobile garage. However, if this is not possible, the location must be within 2 kilometers in a straight line from both the business office and the car garage.
・Having sufficient scale and appropriate equipment to carry out the business plan accurately.
・It must be clearly separated from parts used for other purposes and can be used by drivers at all times in accordance with the business plan.
・The applicant must have the right to use the land and building for three years or more.
・Do not conflict with related laws and regulations such as the Building Standards Act, City Planning Act, Fire Service Act, and Agricultural Land Act.
④Vehicle
・One or more business vehicles must be located at one business office.
・The applicant must have the right to use the product.
・Business vehicles used exclusively for welfare transportation business shall be the following vehicles.
(1) Welfare vehicles prescribed in Article XNUMX-XNUMX, Paragraph XNUMX, Item XNUMX of the Road Transport Act Enforcement Regulations (vehicles with special equipment such as lifts, slopes, and beds for wheelchairs or stretchers, or rotating seats) (hereinafter referred to as "welfare vehicle").
(2) Notwithstanding ① above, if a general vehicle such as a sedan is used, the vehicle must be operated by a person who meets the requirements.
Other Information
① Joining social insurance
Corporations are compulsorily covered by social insurance, so they must be covered by the Health Insurance Act, Employees' Pension Act, Workers' Accident Compensation Insurance Act, and Employment Insurance Act.
②Purchase liability insurance
All vehicles must have liability insurance. As a minimum standard, it is necessary to take out voluntary insurance of at least 80 million yen per person and 2 million yen or more for property.
③Legal compliance
The applicant (in the case of a corporation, all officers) must fall under all of (a) to (h), and there is no problem in terms of legal compliance.
(b) Suspension of use or restriction (prohibition) of use of transportation facilities for vehicles or less for 3 months before the application date and 50 days after the application date due to violation of the Act, Truck Transportation Business Act, Taxi Business Proper Measures Act, etc. Not a person who has been punished
(b) Suspension or suspension of use of transportation facilities for more than 50 days and less than 190 days for 6 months before the application date and after the application date due to violation of the Law, Truck Transportation Business Law, Taxi Business Proper Measures Law, etc. Must not be a person who has been subject to restrictions (prohibitions).
(c) Suspension of use or restriction (prohibition) of use of transportation facilities for vehicles exceeding 1 year from the date of application and 190 days after the date of application due to violation of the Law, Truck Transportation Business Law, Taxi Business Proper Measures Law, etc. The person must not have been punished.
(D) Acts that ensure transport safety, prohibit acts that impede public convenience, and impede public welfare due to violations of laws, the Truck Transportation Business Act, the Act on Special Measures for Proper Taxi Operations, etc. On the other hand, if an improvement order has been received, the matters ordered must have been improved before the application date.
(e) The applicant must not have had any serious accidents attributable to the applicant within one year of the application date and after the application date.
(F) Violations of the Road Traffic Act that are recognized as particularly serious within one year and after the application date (drunk driving, driving under the influence of alcohol, overworked driving, driving under the influence of drugs, etc., driving without a license, driving without a vehicle inspection (without insurance)) and that there is no violation of rescue duty (hit-and-run, etc.).
(g) Various reports based on the Passenger Motor Vehicle Transportation Business Reporting Regulations, Freight Motor Vehicle Transportation Business Reporting Regulations, and Automobile Accident Reporting Regulations are appropriately submitted.
(h) The applicant must not have been subject to a business suspension order, revocation of certification, or business abolition order within two years prior to the application date or after the application date due to violation of the Act on the Appropriation of Business Operations for Automobile Driving Agency Businesses.
