Stockyard operator registration system

The Stockyard Operator Registration System is a relatively new system that began accepting applications on May 5, 5.

This registration system will affect not only businesses that actually operate stockyards, but also construction companies.

1. What is the Stockyard Operator Registration System?

This registration system was established in response to the debris flow disaster that occurred in Atami City, Shizuoka Prefecture in July 2021, with the aim of preventing the occurrence of illegal embankments and ensuring the proper use of construction waste soil.

Business operators that operate stockyards* as part of a "stockyard operation business" can voluntarily apply for registration.

*A place where soil and sand brought in from outside is temporarily stored with the aim of being removed again.

The "Stockyard Management Business Registration Regulations" (hereinafter "Registration Regulations") refer to registered businesses as "Stockyard Management Businesses" and stipulate various matters.

2. Registration validity period

The registration is valid for 5 years.
If you wish to continue your registration, you will need to renew it every five years.

3. Benefits of registration

• There is a high possibility that you will be chosen as a destination for removal by the general contractor.
  Due to a revision of the Ministerial Ordinance (※), from June 6, prime contractors are required to confirm the final destination of construction waste soil. However, if the destination is a registered stockyard, it will be sufficient to check up to the point of soil being transported to the stockyard, which will reduce the burden on prime contractors.
• This can be particularly advantageous when bidding for local governments, etc.
  This is because the client may specify that the destination must be a registered stockyard operator.

4. Relationship with other licenses and permits

The registration application form must state the status of other permits and licenses obtained.

Example:

• Permission for construction work related to residential land development or specific embankments, etc.
• General waste treatment facility installation permit
• Permission or notification under the provisions of local government ordinances regarding the landfill of soil and sand
• Construction permit
• Demolition work registration

5. Necessary procedures after registration

• Annual management status report, etc. (within three months after the end of each fiscal year)
• Report on adverse disposition (within seven days from the date of notification of the adverse disposition)
• Notification of change (within 30 days of the change in registered information)
• Notification of business closure (within 30 days of business closure)

6. Management of the transport of soil and sand

6-1. Confirmation record document at the time of removal

When a stockyard operator intends to transport soil and sand from a stockyard that they operate, they are required to prepare a written record (electronic records are also acceptable) confirming certain items.
In addition, when entrusting the removal of soil and sand, the results of this inspection must be notified.

Furthermore, if the item is subsequently transported from that destination to another destination (※), a document containing the required information must be prepared promptly.

* In the case of places managed by the government or stockyards operated by stockyard operators, no written documentation is required.

6-2. Receipt at the time of delivery

When soil or sand is delivered to a stockyard operator, the operator must issue a receipt (electronic record is acceptable) to the source of the soil or sand.

In addition, when soil and sand are transported to a stockyard operator's stockyard, the operator must request that the recipient be provided with a receipt.

6-3. Management records

When transporting soil and sand, stockyard operators are required to manage and record the amount of soil and sand transported for each source and destination.

6-4. Storage and viewing of records, etc.

Copies of various records such as confirmation records, receipts, and management records must be kept for five years after their creation.

In addition, persons who bring in or remove soil and sand from stockyards operated by stockyard operators (including those who plan to do so) may inspect the records or request our company to do so.

7. Display of signs

A stockyard operator must display a sign in the prescribed format in a location easily visible to the public for each stockyard it operates.

8. Check and consider whether your company and business partners are registered

Confirmation and consideration can be important not only when you are running a stockyard operation business in-house, but also at other times.
