On June 6, 6, the Act to amend the Immigration Control and Refugee Recognition Act and the Act on Proper Implementation of Technical Intern Training for Foreign Nationals and Protection of Technical Intern Trainees was promulgated.
This will result in a fundamental review of the technical intern training system, which aims to contribute to the international community through the transfer of skills, and the creation of a development and employment system aimed at developing and securing human resources in areas where there is a labor shortage.
Objective
To develop human resources with skills at the level of Specified Skills No. 3 through three years of employment in the development and employment industry sector, and to secure such human resources.
Basic policy and operational policy
Formulate basic guidelines for the developmental employment system and operational guidelines for each developmental employment industry sector.
In the field-specific operational guidelines, the expected number of acceptances for each field will be set based on the number of people that will still be insufficient even after improving productivity and securing domestic human resources, and this will be used as the upper limit for the number of acceptances.
Transfer
There are two possible transfer patterns:
① When there are unavoidable circumstances
We allow transfers in unavoidable circumstances, such as when employees have suffered power harassment, violence, or other human rights violations.
② Transfer at the individual's discretion
There are certain requirements for voluntary transfer, as follows:
① The work category of the transferee and the transferee is the same.
② The period during which the employee worked at the previous company exceeds a specified period within the range of one year to two years.
③ The skills and Japanese language ability of the foreign nationals employed in the training program must be above a certain level.
④ The training and employment provider at the transfer destination meets certain requirements that are deemed appropriate.
Family belt
The development employment system does not allow family members to accompany employees.
Change to Specified Skills No. 1
The policy is to allow transition to Specified Skilled Worker No. 1 only if the requirements for transition to Specified Skilled Worker (passing tests related to skills and Japanese language proficiency) are met and the period of employment at the currently employed training and employment institution exceeds a certain period.
The biggest advantage of the developmental employment system is that transfer is now possible under certain conditions.
The developmental employment system is still under discussion. In the future, basic guidelines, operational guidelines, and ministerial ordinances will be prepared and specific requirements will be clarified.
